UNGUARDED PARKING REGULATIONS – WOŹNA 11

I. GENERAL PROVISIONS

  1. These Regulations define the rules for using the unguarded parking lot located at ul. Woźna 11 in Poznań, hereinafter referred to as the "Parking".

  2. By entering the Parking premises, the vehicle driver (hereinafter referred to as the "User") enters into a parking space rental agreement with Mariusz Lipiński conducting business activity in Poznań (ul. Woźna 11, NIP: 8542215497, tel. 663115773, e-mail: info@wozna11.pl), hereinafter referred to as the "Owner" or "Operator", under the terms specified in these Regulations and the provisions of the Civil Code.

  3. The rental agreement is concluded upon the vehicle's entry into the Parking premises and terminates upon the vehicle's departure from the Parking.

  4. Only a User who has a prior, paid parking space reservation linked to their stay at the facility, or who has paid the fee in accordance with the price list in the absence of a prior reservation, is authorized to use the Parking.

  5. The Parking is open and paid 7 days a week, 24 hours a day.

  6. The provisions of the Act of June 20, 1997 – Road Traffic Law apply on the Parking premises. The maximum speed limit on the Parking premises is 5 km/h.

  7. The Parking is intended exclusively for passenger cars and motorcycles whose height does not exceed 185 cm and whose maximum permissible weight (DMC) does not exceed 3.5 tons. The entry of vans, minibuses, buses, or commercial vehicles is strictly prohibited due to technical structural limitations of the infrastructure.

II. FEES AND TERMS OF USE

  1. The fees for renting a parking space are as follows:

    • 80 PLN gross / parking day (from 14:00 to 11:00 the following day), provided a prior reservation is held.

    • 10 PLN gross / for each subsequent commenced hour of extended parking.

    • 400 PLN gross / parking day – fee for using the Parking by persons without a prior reservation or persons who are not guests of the facility (fee for uncontracted use of the surface area).

  2. Leaving a vehicle in the Parking for more than 5 minutes past the end of the paid parking day will result in an automatic charge for the next commenced hour in accordance with the price list.

  3. Guests wishing to receive a VAT invoice must notify the staff directly at the time of payment and provide the company's NIP (Tax Identification Number), in accordance with applicable VAT regulations.

  4. Entry and Exit Procedure:

    • Entry: The User is obliged to pull up to the keypad at the entrance gate and enter the individual access code provided to them.

    • Exit: The User is obliged to settle any applicable fees for additional parking hours and then press the gate open button.

    • Upon entry and exit, the User must strictly wait for the entrance gate to open completely. Entering too early, reversing, or stopping the vehicle within the gate's path risks causing damage to the vehicle and the parking equipment. The costs of repairing equipment damaged due to non-compliance with this rule shall be borne entirely by the User.

III. SAFETY REGULATIONS

  1. The User is obliged to park the vehicle exclusively within the designated parking spaces marked with white horizontal lines, in a manner that does not obstruct the use of the Parking by other individuals.

  2. The following actions are strictly prohibited on the Parking premises:

    • Leaving vehicles in traffic lanes, fire lanes, or within the path of the entrance gate.

    • Leaving vehicles with the engine running.

    • Bringing in, parking, or storing flammable, explosive substances, liquid fuels in containers, or using open fire.

    • Parking vehicles with leaking fluid systems (coolant, fuel, oil).

    • Performing technical maintenance, washing, vacuuming, repairing vehicles, or changing operating fluids.

    • Bringing in and parking any type of trailers.

    • Presence of unauthorized persons, consumption of alcohol, and smoking of tobacco or e-cigarettes on the premises.

    • Riding skateboards, rollerblades, scooters, etc.

    • Leaving animals inside parked vehicles. Intervention to save an animal's life will be carried out through the relevant state services at the User's expense.

IV. LIABILITY

  1. The Parking is unguarded and unmonitored by custody staff. The CCTV monitoring system and the support of the security firm "USI" serve exclusively to protect the property and infrastructure of the Owner and to record events; they do not constitute a basis for a safekeeping/custody contract.

  2. The Owner/Operator of the Parking is not liable for the loss, theft, or damage to the vehicle, nor for the theft or damage to items left inside the vehicle by third parties, as well as for damage caused by force majeure (natural elements, weather anomalies), unless the damage resulted from proven intentional fault or gross negligence on the part of the Owner or their staff.

  3. The Parking User bears full material liability for all damages caused to the Owner or third parties (including other users) on the Parking premises by themselves, their passengers, accompanying persons, or animals under their care.

  4. The User is financially responsible for any contamination of the Parking (e.g., fluid leaks from a faulty vehicle) and for damages resulting from disclosing the access code to unauthorized persons.

  5. In the event of damage for which the User believes the Owner bears responsibility, the User is obliged to immediately inform the Reception/Operator to draw up an incident protocol. Reporting the damage after leaving the Parking does not exclude the right to file a complaint; however, it may make it difficult to prove a causal link between the stay at the Parking and the occurred damage.

V. SANCTIONS AND FINAL PROVISIONS

  1. Violation of the rules of these Regulations by the User, in particular parking in traffic lanes, fire lanes, or the entrance gate, as well as contaminating the facility, will result in a flat-rate additional fee of 500 PLN gross for each day of violation.

  2. In the event that a parked vehicle poses an immediate threat to human life, health, or property (e.g., fuel leak, fire), as well as in the case of blocking an evacuation route, the Operator reserves the right to tow the vehicle at the expense and risk of its owner/user.

  3. Complaints regarding parking services should be submitted in writing to: Aparthouse Woźna 11, ul. Woźna 11, 61-777 Poznań, or electronically to: info@wozna11.pl. The complaint will be reviewed within 14 calendar days from the date of its receipt.
